General Conditions of Sale

1. Definitions

In these conditions 'the company' means Jennifer Myers Ltd and 'the customer' means the person or company to whom this document is addressed.

2. Conditions

These conditions shall form the basis of the contract between the company and the customer. Notwithstanding anything to the contrary in the customer's standard conditions of purchase, these conditions shall apply except so far as expressly agreed in writing by the head office of the company. No servant or agent of the company has power to vary these conditions orally or to make representations or promises about the condition of the goods, their fitness for any purpose or any other matter whatsoever.

3. Order Acceptance

Unless otherwise expressly stated in writing, all quotations and estimates by the company are invitations to treat. The customer's order is an offer and will become binding upon the company posting its conformation of the order. A confirmed order may only be cancelled or varied with the company's consent; the giving of the company's consent shall not in any way prejudice the company's right to recover from the customer full compensation for any loss or expense arising from such cancellation or variation.

4. Delivery

The customer shall note any claim for short delivery and/or for damage to components on the delivery schedule at the time of delivery and shall confirm such claims in writing to the company's head office within three working days from the date of delivery. Compliance with this requirement shall be a condition precedent to any claim for short delivery and/or damage components. If short deliver does take place, the customer undertakes not to reject the goods but to accept the goods delivered as a part performance of the contract.

The company undertakes to use its best endeavours to despatch the goods on a promised delivery date, but does not guarantee to do so. Time of delivery shall not be of the essence of the contract unless expressly so stipulated in writing. If delivery is delayed by strikes, lockouts, fire, accidents, defective materials, delays in receipt of raw materials or bought-in goods or components, or any other cause beyond the reasonable control of the company a reasonable extension of the time for delivery shall be granted and the customer shall pay such reasonable extra charges as shall have been occasioned by the delay.

5. Delivery Schedule

UK Up to 7 days
Rest of Europe Up to 14 days
Rest of the World Up to 21 days

6. Cost Variation

All quotations and estimates issued by the company are, unless otherwise stated, based on current cost of production (materials, hours and wages) and are subject to amendment on or after acceptance to meet any recognised rise or fall in such cost.

7. Government Taxes or Levies

Any variation to prices quoted as a result of government taxes and levies will be for the customer's account.

8. Terms of Sale

The customer shall make payment in full prior to delivery. The ownership of materials delivered by the company shall only be transferred to the customer when the customer has met all that is owing to the company on whatever grounds. The risk of accidental deterioration or destruction shall pass on delivery and the customer shall insure against such risk. The customer shall pay all accounts in full and not exercise any rights of set-off or counter-claim against invoices submitted.

9. Privacy Policy

The Company does not disclose buyers' information to third parties unless you give us permission to do so, other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

10. Return of goods- Cancellation of order

We hope you will be pleased with your purchase.

If you change your mind once you have placed your Order, please notify us in writing of your wish to cancel the Order immediately. If we receive notification of Cancellation before we process your Order, we will happily refund you in full including any delivery costs charged.

Should you wish to return anything bought from us, we will be happy to refund a product, provided it is in fully re-saleable condition and has not been opened. Returns should be made within seven days and in original, undamaged packaging.

Before sending the parcel back to us, please contact us. You will be asked for the reason for the return including whether you will prefer a refund or exchange plus whether the item has been used. In addition, you will need to confirm your name, order number and postcode, so please have these available if you telephone.

If the product returned is not in fully re-saleable condition or the packaging is damaged, we reserve the right to refuse a refund on the item. This does not affect your statutory rights.

Please note that Jennifer Myers Ltd will not pay for the cost of Return delivery.

We try to make refunds within one week of receipt back to us though promise to make all refunds within 30 calendar days from receipt of goods to our warehouse.

11. Law of the contract

English law shall be the proper law of the contract.
